Minnetonka Fence Code

Fence Rules

This handout summarizes requirements for fence construction on single-family residential properties.

However, it is not all inclusive. Please contact a planner at 952-939-8290 with specific questions regarding

your project.

Permit: A building permit is required for any fence over 6-feet in height.



Location on a “Standard Lot”: Fences must be located on private property. It is a property owner’s

responsibility to determine where property lines are located. There is no minimum setback for fences from

property lines. However, fences must maintain minimum setbacks from natural features, including: ordinary high

water level of lakes and creeks, 100-year and floodplain elevations, and the delineated edge of wetlands. If your

property includes any such features, please contact a planner regarding your project.



Location on a “Corner Lot”: No fence over

2.5 feet in height may be located within 25 feet

of a paved intersection.



Easements: Many residential properties

contain easements, either public or private. A

fence placed in an easement is placed there at

a property owner’s own risk.



Fence Orientation: Fencing materials may

be placed on either side of support posts.

There is no “right-side/wrong-side” rule.



Pools and Spas: A non-surmountable fence

5-feet in height is required around all residential

pools and spas. Specific questions regarding

this regulation should be directed to the

Environmental Health Division at 952-939-

8200.

When is a permit required?



Fence installations, alterations or repairs do not require a

permit, with the following exceptions:

• A fence taller than six feet in height requires a building

permit from the Building and Inspection Division


before


the fence is installed.

• A fence within a floodplain requires a permit from the

Building and Inspection Division

before installation.

• A fence within a shore area that is not more than 10

feet inland from the ordinary high water level (OHWL)

requires a shore area permit from the Building and

Inspection Division

before installation.

• A fence may not be placed in the right-of-way without

approval and an encroachment agreement.


Code requirements apply even if a permit is not required.

The following regulations apply to fence height, subject to

the exceptions in the next column. For height

requirements, an alley is not considered a street.

Exceptions



1. A residential fence in a yard adjacent to an arterial

street as designated by the

Comprehensive Plan may

be a maximum height of six feet.

See map on page 4.

2. A residential fence that meets the required setback

from a specific property line for a principal structure in

its zoning district may be eight feet high. A permit is

required.

3. A residential fence in the rear yard of a corner lot may

be six feet high if the fence meets the minimum

setback from the street for a principal structure in its

zoning district or provided the fence is no closer to the

street than the principal structure or garage.

4. A residential fence in the rear yard of a through lot

when both adjacent lots are also through lots may be

six feet high.

5. A residential fence adjacent to a nonresidential use

may be eight feet high. A permit is required.

Subd. 5
Fences in the R-1 and R-2 Districts. Fences erected in the R-1 District and R-2

District shall conform to the following:

A. Fences exceeding four feet in height shall not be erected within a required front street

setback or side street setback, pursuant to the provisions of paragraph 2. of Subd. 7 of Subsection

850.11.

B. No fence shall exceed six feet in height.

C. Fences shall be installed with the finished side facing neighboring properties.

D. No fence shall be installed so as to obstruct a required clear view at street intersections as

required by Section 1405 of this Code.
